Order on Motion to Stay
Minute Order by Judge Jinsook Ohta: On August 7, 2026, the parties filed a joint motion to stay this case pending arbitration, representing that they previously entered into a Mutual Agreement to Arbitrate Disputes and that Plaintiff has agreed to arbitrate all asserted claims pursuant to that agreement. Dkt. 10. In determining whether to grant a stay, courts consider (1) the potential harm from a stay, (2) the hardship or inequity of proceeding, and (3) whether a stay would promote the orderly course of justice by simplifying the issues, proof, or questions of law. Landis v. N. Am. Co., 299 U.S. 248, 254 (1936); CMAX, Inc. v. Hall, 300 F.2d 265, 268 (9th Cir. 1962). Here, the parties have agreed to arbitrate Plaintiff's claims, and a stay would promote judicial economy while the claims proceed in arbitration. The parties also identify no prejudice or hardship resulting from a stay. Therefore, the Court GRANTS the joint motion [Dkt. 10] and STAYS this case pending arbitration.
