DOCKET TEXT ORDER taking under advisement 193 Motion for Civil Contempt Sanctions. Plaintiffs' counsel shall within 21 days prepare, file under the CM/ECF event Notice of Filing and submit in PDF and Word format to Mr. Gifford and to dj.nuffer@utd.uscourts.gov a draft order consistent with the form of the 162 order. The draft order must recite the history of relevant events since that 162 order was entered, the evidence presented by Mr. Gifford actually relevant to the issue of his inability to pay, reciting and rejecting his evidence which is irrelevant, and drawing conclusions of law as to the current contempt and propriety of monetary and incarceration remedies designed to compel compliance with the court orders. An in-person hearing will be held within 30-45 days of the submission of that draft order. At that hearing the 193 Motion for Civil Contempt will be adjudicated, and if Mr. Gifford is still in unexcused violation of this court's orders, penalties will be imposed and incarceration ordered.
