Order Dismissing Party ~Util - Set/Reset Deadlines
PAPERLESS ORDER. THIS MATTER is before the Court sua sponte. Plaintiff filed the Complaint on February 11, 2026. (DE 1 .) On April 15, 2026, the Court observed that there was no evidence Plaintiff had served Defendant Sergio Valle. Pursuant to Rule 4(m) of the Federal Rules of Civil Procedure, the Court gave Plaintiff until May 12, 2026, to serve Defendant Sergio Valle. (DE 26). The day before that deadline passed, Plaintiff sought, and was granted, an extension through July 13, 2026, to serve Defendant Sergio Valle. Plaintiff failed to file valid proof of service as to Defendant Sergio Valle by the Court's deadline. Accordingly, it is ORDERED AND ADJUDGED that Defendant Sergio Valle is DISMISSED WITHOUT PREJUDICE in accordance with Rule 4(m) of the Federal Rules of Civil Procedure.
In light of the Court's dismissal of Defendant Sergio Valle, on or before August 5, 2026, the remaining Parties shall file a joint conference report and a joint proposed scheduling order, as required by S.D. Fla. Local Rule 16.1(b).
