Order on Motion for Extension of Time to Complete Discovery
ORDER: The joint request for extension of time to complete fact discovery concurrent with expert discovery, see ECF No. 66 , is granted. Fact discovery and expert discovery closes 12/11/2026. By the same date, the parties must file a joint letter certifying discovery as complete. Counsel should not expect additional extensions absent good cause and due diligence having been shown.
The joint request for settlement conference, see ECF No. 66 , is also granted. The parties are scheduled for a Settlement Conference on 10/22/2026 at 2:30 PM before Chief Magistrate Judge Vera M. Scanlon over ZoomGov. The Court will email the ZoomGov login information to counsel separately. Given the date of the Settlement Conference, the parties should discuss the expert report deadlines amongst themselves and request an extension if needed.
By 10/8/2026 the parties are directed to submit ex parte settlement letters by email to Chambers at scanlon_chambers@nyed.uscourts.gov. Ex parte settlement letters shall state (1) the status of settlement discussions; (2) the last demand and offer made, if any; (3) the strengths and weaknesses of the case; and (4) any information that may assist the Court in helping the parties resolve the matter. The parties are encouraged to discuss settlement prior to submission of the ex parte letters. The ex parte letters shall be limited to 3,500 words, not including exhibits.
The Court will conduct a pre-settlement conference call with each side's counsel separately on 9/29/2026. One call will take place at 2:00 PM and the other call will take place at 5:00 PM. Each call will take no more than 30 minutes. Counsel shall confer amongst themselves and then contact chambers to provide their contact information and inform the Court of which timeslot they have selected.
