Order on Motion to Adjourn Conference 1 - Terminate Deadlines and Hearings
ORDER. Plaintiff's counsel filed a motion for adjournment late, and did not appear at the 7/8/2026 conference. See ECF No. 11 . Plaintiff's counsel must order a transcript of the 7/8/2026 conference at her own expense, not her client's, and read it. On or before 7/15/2026, Plaintiff's counsel must file letter explaining her absence from the conference.
The motion at ECF No. 11 is granted in part and denied in part. The conference proceeded as scheduled; however, discovery is adjourned in light of the information that the parties anticipate settling this matter within weeks. The Court noted on the record that appearing Defendant has not yet answered or responded in this action. If the case proceeds, Defendant must do so by 8/14/2026.
The parties must consider how to proceed as to the non-appearing Defendant 4718 Vernon, LLC. Defendant's counsel stated on the record that he believes Plaintiff will voluntarily withdraw the lawsuit as to Defendant 4718 Vernon, LLC. On or before 8/7/2026, the parties must the appropriate closing papers or a joint status letter. The filing must include the parties' plans as to how they are proceeding as to the non-appearing Defendant. If the parties do not settle, they must propose possible dates for a discovery conference.
