FIRST AMENDED CIVIL CASE MANAGEMENT PLAN AND SCHEDULING ORDER granting 76 Letter Motion for Extension of Time to Complete Discovery; granting 77 Letter Motion for Extension of Time to Complete Discovery. All parties do not consent to conducting all further proceedings before a United States Magistrate Judge, including motions and trial. 28 U.S.C. § 636(c). All fact discovery shall be completed no later than 9/21/2026. All expert discovery, including reports, production of underlying documents, and depositions, shall be completed no later than 12/18/2026. Expert Deposition due by 12/18/2026. A conference regarding either submitted summary judgment letters or a joint status letter, as described further below in Paragraph 9, will be held on 10/15/2026 in Courtroom 906 of the Thurgood Marshall Courthouse, 40 Foley Square, New York, New York 10007. This case is to be tried to a jury. Counsel for the parties have conferred and their best estimate of the length of trial is 15 days. GRANTED. The Court adopts the proposed schedule set forth above. The post-fact discovery conference previously scheduled for July 23, 2026 is hereby ADJOURNED until October 15, 2026 at 9:30 A.M. The parties are reminded to comply with the Court's post-fact discovery procedures as set forth in Paragraph 9 of the Civil Case Management Plan and Scheduling Order and the Court's Individual Rule II(B)(9).
