DEFAULT JUDGMENT: It is, ORDERED, ADJUDGED AND DECREED: that Plaintiffs have judgment against Defendant in the liquidated amount of Twenty-Five Thousand Five Hundred Eight Dollars and Forty Three Cents ($25,508.43) which includes the follo wing: $24,134.63 in unpaid fringe benefit contributions and for the period January 1, 2016 through to and including October 30, 2020 (audit findings); $2,598.82 in interest calculated at 10% per annum for each delinquent month throug h the date of the Audit Report, December 10, 2020; $2,413.46 in liquidated damages calculated at 10% of the principal amount due for the period January 1, 2016 through October 30, 2020; audit cost in the amount of $6,042.90; attorne ys' fees in the amount of $1,485.00; court costs and disbursements in the amount of $472.00 pursuant to the Agreement and in accordance with Section 502(g)(2)(D) of ERISA 29 U.S.C. 1132 (g)(2)(D)); and credit for payment made reducin g the total balance by $11,638.38. ORDERED, that the Judgment rendered by the Court on this day in favor of the Plaintiffs is entered as a final judgment against Defendant and the Clerk of the Court is directed to enter such judgment forthwith. DEFAULT JUDGMENT: It is, ORDERED, that the Defendant permit and cooperate in the conduct of an audit of its books and records including, but not limited to, all payroll journals, business income tax returns, general ledger and journal, books o f original entry, subsidiary ledgers, payroll records, bank statements, and cancelled checks, W-2 and W-3 forms, 940,941, WT4-A and WT4-B forms, 1099 forms, New York State employment report, insurance reports, disability insurance reports, Workers Compensation report forms and remittance reports for the period January 1, 2018 through to December 31, 2020 in accordance with the terms and conditions of the Painters Trade Agreement (Doc. 13-1); and it is further ORDERED, that the Court shall retain jurisdiction over this action for the limited purpose of permitting Plaintiffs to supplement their application by affidavit by a person with personal knowledge, and memorandum of law in support thereof, to include the amounts, if any, deter mined by the audit to be due and owing, together with interest, liquidated damages, auditors' fees, and attorneys' fees; and it is further ORDERED, that the Judgment rendered by the Court on this day in favor of the Plaintiffs be entered as a final judgment against Defendant and the Clerk of the Court is directed to enter such judgment forthwith.
