ORDER re 34 Motion for Sanctions: (1) Plaintiffs' motion for sanctions (D.E. 34) is GRANTED IN PART. As discussed above, the Court FINDS that Defendants violated the Court's prior order (D.E. 24) under Federal Rule of Civil Procedure 37(b)(2)(A) and did not comply with Rule 37(e). (2) Under Rule 37(e)(1), Defendants are PRECLUDED from representing Exhibit 1 (D.E. 35-1), Exhibit 7 (D.E. 35-7), or the deposition recording as a complete record of the WhatsApp communications at issue. (3) Plaintiffs request for attorney fees and expenses under Rule 37(b)(2)(C) is GRANTED, but the amount due will only be assessed after this discovery-dispute litigation is concluded. The depositions allowed herein, should they occur, will be conducted at Defendants' expense.(4) Plaintiffs' other requests for relief (D.E. 34 & 34-6) are DENIED WITHOUT PREJUDICE.; Defendants are warned that any failure to cooperate in depositions or additional failure tocomply with the Court's discovery orders could result in additional, more severe, sanctions,including contempt and default judgment against the disobedient party.
