ORDER. Matthew F. Page and Brittney H. Page have resolved their cross-claims and are due to be dismissed from the suit. The Joint Motion for Entry of Partial Consent Judgment, ECF No. 174 , is GRANTED. Pursuant to the Parties' consent and settlement agreement, the Clerk is directed to enter a partial consent judgment in favor of Plaintiffs Jeanne M. and Jeffrey S. Smith and against Defendant Coleman Coastal Construction, LLC, d/b/a Coleman Renovation and Remodeling in the amount of $400,000, pursuant to their agreement. The Court is not reserving jurisdiction to enforce the terms of their settlement agreement. On notice that all claims against Zion Builders, LLC, have been settled, the third-party claim against Zion Builders is moot and dismissed from the Court's active docket. In the event the settlement is not consummated, the Court reserves the power to reopen the case for further proceedings on motion filed within sixty (60) days of the date of this Order and a showing of good cause. At this time, the Clerk is directed to close the file in this case for administrative purposes. At the expiration of sixty (60) days without activity, the Clerk is directed to close the case in its entirety for all purposes. Signed by JUDGE M CASEY RODGERS on 09/21/26. (jfj)
