TEXT ORDER entered by Judge Sue E Myerscough on 4/19/2024. On March 18, 2024, the government filed a Notice of Dismissal of Criminal Action due to the Death of Criminal Defendant John W. Jackson Jr. 112 . On March 21, 2024, the Court held a status conference where a discussion was held regarding the termination of deceased party John Jackson. On April 1, 2024, Defendants and Third-Party Plaintiffs Shirley Swartz and Steven Swartz filed a Motion for Default Judgment, Declaration in Support, and Motion for Declaratory Judgment. 113 , 114 , 115 . No response has been received to date. Pursuant to Federal Rule 25(a) and given Defendant Jackson's death does not extinguish this action, the Court has the discretion to require the parties to substitute a proper party in his place. Further, if no motion for substitution has been made within 90 days of a suggestion of death, the action against the decedent must be dismissed. Given the facts at issue here and the ongoing and continued litigation, the Court DENIES Defendants and Third-Party Plaintiffs' Motions. 113 , 114 , 115 . However, the Court sua sponte DISMISSES Defendant Jackson from this action. (RES)
