ORDER: Despite a warning that Default was a possible sanction, Defendant Visionary Construction, Inc. failed to comply with Court's Order at CM/ECF 95 as no counsel has appeared on its behalf by June 16, 2026 deadline. Moreover, the Court takes judicial notice of Visionary's non-compliance with Court Orders in case No. 24-1272. Accordingly the Clerk of the Court shall enter default upon Visionary Construction, Inc. See Hooper Has v. Ziegler Holdings, LLC, 690 F.3d 34, 37-38 (1st Cir. 2012)("[D]efault may be a condign sanction when a court is confronted with a persistently noncompliant litigant"). The Clerk of the Court shall serve copy of this order upon Defendant Visionary Construction, Inc. at its address of record. Signed by Judge Raul M. Arias-Marxuach on 6/24/2026. (mrr)
