- Order (PAPERLESS or pdf attached)
PAPERLESS ORDER REQUIRING RESPONSE to 38 Defendants' Motion to Compel Arbitration and to Stay Intervenor's Claim Pending Arbitration. Pursuant to Southern District of Florida Local Rule 7.1(c)(1), "[E]ach party opposing a motion shall file and serve an opposing memorandum of law no later than fourteen (14) days after service of the motion." Here, the Motion was filed on June 17, 2026, and, therefore, the response was due on July 1, 2026. To date, Intervenor, CB Marine Towing and Salvage, Inc. ("Intervenor"), has failed to file a response or request additional time to do so. Local Rule 7.1(c)(1) also provides that failure to timely respond "may be deemed sufficient cause for granting the motion by default." Accordingly, it is ORDERED that Intervenor shall file a Response to the 38 Motion no later than July 10, 2026. Failure to timely file a Response will result in the granting of the Motion by default and staying the Intervenor's claim without further notice. Signed by Judge Melissa Damian on 7/6/2026. (bzy)
