Each side shall submit prior to the start of the hearing, a proposed order which includes findings of fact and conclusions of law for each motion being heard. It is FURTHER ORDERED that Defendant MPC, Inc.'s Motion to Dismiss (Doc. 4 ) is DENIED WITHOUT PREJUDICE. It is FURTHER ORDERED that this case is STAYED pending the outcome of arbitration. The Court retains jurisdiction of this case for the purpose of (1) confirming or seeking to vacate any arbitral award; or (2) approving any settlement of Plaintiffs' FLSA claims.
