ORDER: For the reasons stated in the accompanying Order, the Court grants Resolve's motion for summary judgment on all claims against it 157 . The Court also denies Surge's motion in its entirety 161 . While the Court agrees that the non-compete covenant is unenforceable as a matter of law, the Court cannot grant judgment in Tolbert's favor on this claim because Tolbert did not cross-move for summary judgment. Given this unusual procedural posture, the Court instructs the parties to file a joint status report within seven days, on or before September 1, 2026, regarding how Surge's claim for breach of the non-compete can proceed against Tolbert.
