TEXT ORDER: After a pleading is dismissed, the party that filed the pleading may for some purposes no longer be a party to the case. But that party remains in the case for the purposes of its seeking to file a new complaint --- at least in circumstances like this one, in which, among other things, judgment has not yet been entered. Against this backdrop, Plaintiff James D'Amato shall be permitted to file a motion before the United States Magistrate Judge seeking leave to file an amended complaint. All objections to the motion for leave may be addressed to the Magistrate Judge --- except for objections grounded in futility, which is better handled later, in a free-standing Rule 12 motion to dismiss. Any motion for leave to file an amended complaint must be filed on or before October 18. It will not be accepted after that date. This text order disposes of the motion at ECF 160 .
