Minute Entry for proceedings held before Magistrate Judge Lee G. Dunst: Initial Conference Hearing held on 10/8/2026.
For the reasons stated on the record, the parties' Proposed Scheduling Order (DE 9 ) is APPROVED in part as follows: (1) date for completion of automatic disclosures required by Rule 26(a)(1) of the Federal Rules of Civil Procedure, if not yet made, is 11/05/2026; (2) date for completion of fact discovery is 2/26/2027; (3) date for exchange of expert reports is 5/28/2027; (4) date for completion of expert discovery is 7/30/2027; (5) date for submission of joint certification of completion of all discovery is 8/26/2027; and (6) final date for all dispositive motion practice is 9/30/2027. The Court currently declines to schedule a date for preliminary discovery and for a settlement conference.
Additionally, any motion to amend the pleadings to add claims or join additional parties must be filed by 1/8/2027 (which is advanced from the parties' requested date of 2/26/2027). Any such motion filed on or after 1/9/2027 will be denied absent a showing of good cause under Fed. R. Civ. P. 16(b)(4). See Sacerdote v. New York University, 9 F. 4th 95, 115 (2d Cir. 2021).
The parties are directed to submit a joint status report by 12/18/2026.
