Status Conference Order on Motion for Discovery ~Util - Set Deadlines/Hearings
MINUTE ENTRY AND ORDER: A Status Conference was held before Magistrate Judge Peggy Kuo on July 30, 2026 by video. Joshua Branson, Esq., Andrew Goldsmith, Esq., James Ruck, Esq., and Matthew Fisher, Esq. appeared on behalf of Plaintiffs. David Bowker, Esq., Jonathan Paikin, Esq., Alyson Zureick, Esq., Albinas Prizgintas, Esq., and Michaela Wilkes Klein, Esq. appeared on behalf of Defendants. No other appearances.
The parties were heard on the 91 Motion for Discovery, and the Court made rulings on the record.
The parties discussed the issues raised in the July 23, 2026 Joint Status Report regarding Defendants claims of privilege over their preservation and collection process. Plaintiffs stated that they intend to move for spoilation sanctions, and these issues would be relevant for the Court to consider under Federal Rule of Civil Procedure 37(e). The parties are directed to propose a briefing schedule for Plaintiffs' anticipated spoilation motion by August 4, 2026.
A status conference is scheduled for September 1, 2026 at 9:30 a.m. before Magistrate Judge Peggy Kuo by video. The parties are directed to file a joint status report no later than 5:00 pm on August 26, 2026, outlining the progress of discovery. If there are unresolved discovery issues that need to be raised at the September 1, 2026 Status Conference, the parties must clearly and succinctly set out their positions on each disputed issue in the joint status report.
The joint status reports are limited to a chart outlining the issues and two pages for each disputed issue. If the parties require judicial intervention prior to September 1, 2026 Status Conference, they are directed to file a joint letter no longer than two pages detailing their positions for each disputed issue.
Links to access these Zoom meetings will be provided to counsel separately. The parties are directed to log onto the platform at least 10 minutes before the start of the conference. Only counsel who have filed notices of appearances two business days before the conferences may appear on the record.
