ORDER-- The subpoena directed at Yoel Getter was properly issued and as noted in the attached Order, properly served. It complied with the form and content requirements under Federal Rule of Civil Procedure 45(a)(1)(A), see Dkt. No. 50, and was personally served on Mr. Getter on December 1, 2025. (Dkt. No. 74, Affidavit of Service.) Moreover, Mr. Getter's deposition testimony and the documents sought are relevant to the proceeding because Mr. Getter was a sales agent of Defendant Brezel and the documents Plaintiffs are requesting to be produced relate to the Merchant Cash Advance business between the parties that is the basis of this case. (Dkt. No 62, Status Report; Appendix 1 to Dkt. No. 53-1, Documents to be Produced.)
Accordingly, Mr. Getter is COMPELLED to respond satisfactorily to the outstanding subpoena issued to him. By July 17, 2026, he must have substantially complied with the subpoena, including coordinating the scheduling of his deposition with Plaintiffs' counsel and producing responsive documents. If Mr. Getter is not in possession of any relevant documents, he must so certify to Plaintiffs' counsel in a declaration. Failure to comply with this Order may result in monetary sanctions and in Plaintiffs bringing a successful motion for contempt. If this Court holds Mr. Getter in contempt, he may be subject to sanctions, including, but not limited to, monetary sanctions and arrest. If a person is arrested for contempt of court, the person may beheld in custody.
It is further ORDERED that Yoel Getter appear on August 6, 2026 at 12:00 PM in Courtroom 322N of the United States District Court for the Eastern District of New York, 225 Cadman Plaza East, Brooklyn, NY 11201 unless he has received confirmation from Plaintiffs' counsel that he has substantially complied with the subpoena. At the August 6 hearing, the Court will hear argument on any motion for contempt and will issue decisions regarding requested monetary and criminal sanctions.
Plaintiffs' counsel shall update the Court regarding Mr. Getter's compliance in the status report due July 27, 2026. Should he still be non-compliant, Plaintiffs may move the Court for an order of contempt at that time. Plaintiffs' counsel is directed to serve a copy of this Order by FedEx delivery on Mr. Getter by July 7 and shall negotiate in good faith should Mr. Getterrequest reasonable limitations to the scope and timing of his compliance with the document subpoena and rescheduled deposition via video conference. Plaintiffs' counsel shall file proof of service of this Order thereafter. If Plaintiffs' counsel moves the Court for an order of contempt, Plaintiffs' counsel is directed to serve the motion on Mr. Getter within one day of filing the motion.Ordered by Magistrate Judge Peggy Cross-Goldenberg on 6/30/2026.
