ENDORSED ORDER re: 77 MOTION for Attorney Feesand Costs. Text of Order: Before the court is plaintiff's motion for attorney's fees and costs (doc. no. 77). In their objection, defendants argue that plaintiff is seeking fees for discovery conducted in the Georgia litigation. Defendants also argue that plaintiff's requested fees must be reduced because plaintiff was unsuccessful in pursuing his FLSA claim. Therefore, on or before April 19, 2024, plaintiff shall file a supplement, further explaining: (1) the extent to which plaintiff seeks fees for discovery from the Georgia litigation and why such a request would be reasonable in this case, and (2) the extent to which hours spent on the FLSA claim can be separated from the New Hampshire wage law claim, see Lipsett v. Blanco, 975 F.2d 934, 941 (1st Cir. 1992) (If the fee-seeker properly documents [his] claim and plausibly asserts that the time cannot be allocated between successful and unsuccessful claims, it becomes the fee-target's burden to show a basis for segregability.).
