OPINION AND ORDER. Defendants' motion to dismiss [ECF 6 ] is GRANTED IN PART and DENIED IN PART. Defendants' motion to dismiss for lack of subject matter jurisdiction is granted as to Plaintiffs' BFD claims but denied as to their waitlist claims. Defendants' motion to dismiss for failure to state a claim is denied. Defendants are ORDERED to file their answer to the surviving portions of Plaintiffs' complaint within 14 days of this Order. The parties are ORDERED to file their Joint Preliminary Report and Discovery Plan required by LR 16.2, NDGa, within 30 days of Defendants' answer.
