Order Dismissing Case ~Util - Terminate Motions
MEMORANDUM ORDER (Granting Defendants' Motions to Dismiss) - For the reasons set forth above, the Court hereby GRANTS Defendant Bynum's Motion to Dismiss (ECF No. 13 ) and GRANTS Defendant Hyman's Motion to Dismiss (ECF No. 20 ). Accordingly, the Court ORDERS as follows: 1. Plaintiff's claims against Defendant Bynum are DISMISSED WITHOUT PREJUDICE for lack of personal jurisdiction; 2. Plaintiff's claims against Defendant Hyman under the Federal Trade Commission Act, 15 U.S.C. § 45(a); Article I, Section 10 of the United States Constitution; 12 U.S.C. § 412; and 28 U.S.C. § 3002(15) are DISMISSED WITHOUT PREJUDICE for lack of subject matter jurisdiction; and 3. Plaintiff's remaining federal claims against Defendant Hyman under the Truth in Lending Act, 15 U.S.C. § 1601 et seq., and the Fair Debt Collection Practices Act, 15 U.S.C. § 1692 et seq., are DISMISSED WITH PREJUDICE for failure to state a claim upon which relief can be granted. Should Plaintiff desire to appeal, written notice of appeal must be filed with the Clerk of the Court within thirty (30) days of the date of entry hereof. Failure to file a notice of appeal within that period may result in the loss of the right to appeal. The Court DIRECTS the Clerk to CLOSE this case. SEE ORDER FOR DETAILS. It is so ORDERED.
