MINUTE entry before the Honorable John F. Kness: Telephonic status hearing held on 8/19/2026. Counsel for Plaintiff advised the Court that Plaintiff asks for entry of a final judgment order at this time and no longer wishes to pursue any further relief in the case. This request is consistent with Plaintiff's earlier statement that he does not wish to pursue the First Amendment claim stated in Count II of the Second Amended Complaint. Accordingly, construing Plaintiff's statement as an oral motion to dismiss under FRCP 41(a)(2), the motion is granted, and Count II is dismissed. Count I was previously dismissed (Dkt. 116) on Defendant Johnson's motion to dismiss; Count IV was previously dismissed (Dkt. 144) on Defendant City of Chicago's motion to dismiss (Dkt. 133). All claims having been resolved, the case is concluded with a judgment in Plaintiff's favor on summary judgment (see Dkt. 258) as to Count III (state law battery) in the amount of $96,665.45, consisting of $23,915.45 in medical expenses and $72,750 in lost wages.
