Order [non-document]: Defendant Shopno I, LLC seeks clarification of the Court's Protective Order to state whether the Protective Order prevents it from responding in full to a third-party subpoena Gig Forces served on Shopno I, LLC in a separate action pending in state court. (Doc. 31 .) See Encore Funding II, LLC v. Gig Forces, et al., Cuyahoga County Case No. 25 115446. Plaintiff Encore Funding II, LLC filed a motion to quash the subpoena in the state court action, and that motion appears to be pending. Plaintiff Encore Funding II, LLC responds here by asserting no judicial action is necessary because the enforceability of the subpoena is being determined in state court. (Doc. 32 .) Having reviewed the Protective Order and the parties' briefing on this issue, the Court hereby clarifies that the Protective Order does not, by itself, preclude a signatory/party from complying with a properly issued subpoena in the state court action.
