ORDER: On June 15, 2026, the Court adjourned an evidentiary hearing in this case sine die pending Peter Hoffmans availability. (Dkt. #348). On September 9, 2026, Intervenor's counsel informed the Court that Mr. Hoffman would be available to att end court proceedings beginning October 1, 2026. Therefore, the evidentiary hearing originally scheduled for June 15, 2026, is hereby rescheduled for October 7, 2026, at 12:00 p.m.The hearing will be held via video conference with public audio access at (855) 244-8681, access code 2315 780 7370. Instructions to video participants will be sent separately in advance of the conference. At the hearing, the Court intends to receive the remaining evidence concerning Picture Pro's and Mr. Hoffman& #039;s alleged failures to comply with this Court's Orders. While the parties can bring to the Court's attention relevant developments in Picture Pro's lawsuits in California state court, and can present arguments concerning the interp lay (or not) between those litigations and this one, the Court does not intend to relitigate the Bermudan law issues resolved in its Order of August 10, 2026. OMNIBUS ORDER DENYING 60 Defendant's Amended and Supplemental Motion to Stay Pending Arbitration; DENYING WITHOUT PREJUDICE 67 Plaintiff's Motion for Sanctions; DENYING 77 Plaintiff's Motion for Default Judgment as to Counts I and V of the Complaint; DENYING 80 Defendant's Motion to Dismiss; GRANTING 85 Defendant's Amended Motion to Vacate and Set Aside the Clerk's Default. In light of this Order, trial in this case is continued to the two-week trial period beginning November 16, 2026, at 9:00 a.m. Counsel shall now report to their final pretrial conference on November 3, 2026, at 11:00 a.m. and the calendar call on November 12, 2026, at 2:00 p.m. The trial, final pretrial conference, and calendar call shall take place in Courtroom 13-1, on the 13th floor of the U.S. Courthouse, 400 North Miami Avenue, Miami, Florida.
