Order on Motion to Continue
PAPERLESS ORDER. THIS CAUSE came before the Court upon Plaintiff's Motion to Hold Final Pretrial Conference by Zoom or to Reschedule. 136 . Therein, Plaintiff seeks to either hold the Final Pretrial Conference, scheduled in this matter for September 22, 2026, by Zoom or to adjourn it until a later day that week. See id. at 1. In support thereof, Plaintiff contends its principal counsel will be unable to appear in person in a timely manner for the Final Pretrial Conference, because he will be traveling from out of state and the Jewish Holiday of Yom Kippur is the day before on September 21, 2026. Id. Defendant does not oppose the Motion. Id. at 2. District courts have 'unquestionable' authority to control their own dockets." Smith v. Psychiatric Sols., Inc., 750 F.3d 1253, 1262 (11th Cir. 2014) (internal citation omitted). "This authority includes 'broad discretion in deciding how best to manage the cases before them.'" Id. (internal citation omitted). Accordingly, UPON CONSIDERATION of the Motion, the pertinent portions of the record, and being otherwise fully advised in the premises, it is hereby ORDERED AND ADJUDGED that the Motion 136 is GRANTED IN PART. Trial in this case is continued to the two-week trial period beginning October 19, 2026, at 9:00 a.m. COUNSEL shall now report to their final pretrial conference on October 6, 2026, at 11:00 a.m. and the calendar call on October 15, 2026, at 2:00 p.m. The trial, final pretrial conference, and calendar call shall take place in Courtroom 13-1, (thirteenth floor) United States Courthouse, 400 North Miami Avenue, Miami, Florida. This continuance does not reopen discovery or give the Parties additional time for pre-trial motions. Signed by Judge K. Michael Moore on 8/12/2026. (srn)
