ORDER granting 102 Motion to Certify Class; granting 105 Motion for Attorney Fees; ORDER DISMISSING CASE-- For the reasons set forth in the attached Order and discussed during the Court's January 30, 2026 Cheeks hearing, the Court grants the parties' motion to approve the settlement agreement and: (1) Approves the settlement and Agreement as fair, reasonable, adequate, and binding on all Class Members who have not timely opted out of the settlement; (2) Orders the Administrator to distribute Settlement Checks; (3) Orders the attorneys' fees of $416,250 and costs of $22,000 to be paid to Class Counsel out of the Settlement Amount; (4) Orders the Administrator's fees and expenses to be paid out of the Settlement Amount; (5) Orders that the Service Awards be paid out of the Settlement Amount; (6) Orders the dismissal with prejudice of all State Law Claims by all Class Members who did not opt-out as well as Named Plaintiffs; (7) Orders the dismissal of FLSA claims for all Class Members who submitted opt-in/Claim forms; (8) Orders entry of dismissal of this action with prejudice; (9) Retains jurisdiction over the interpretation and implementation of the Settlement Agreement as well as any and all matters arising out of, or related to, the interpretation or implementation of the Settlement Agreement and of the settlement contemplated thereby.
