STIPULATION AND ORDER REGARDING TOLLING OF THE STATUTE OF LIMITATIONS WITH RESPECT TO PUTATIVE MEMBERS OF THE COLLECTIVE ACTION: 1. The applicable statute of limitations under the Fair Labor Standards Act ("FLSA") for all putative members of the collective action defined in the Complaint (paragraph 18) and/or the conditional certification of a collective action pursuant to 29 U.S.C. § 216(b) of the FLSA (the "Motion") and/or any other collective that the Court may conditionally certify in this action, shall be tolled from May 21, 2026, through and including the date on which the Court rules on the Motion, or until further order of the Court. 2. This tolling period shall apply solely for purposes of calculating the applicable FLSA statute of limitations as to putative members of the collective action and shall not affect, waive, or extend any other deadline, defense, or limitations period applicable to any party in this action. 3. This stipulation may be executed in counterparts and by facsimile/scanned signatures, which shall bear the same weight as original signatures. In light of this stipulation and consistent with the Court's prior Order, ECF No. 71, the stay with respect to the collective action certification motion remains in effect. The Clerk of Court is directed to amend the case caption consistent with the amended complaint. See ECF No. 72. SO ORDERED. (Signed by Judge Jesse M. Furman on 7/6/2026) (jca)
