Order on Motion to Consolidate Cases
ORDER granting Defendants' 47 Unopposed Motion to Consolidate. The Motion seeks to consolidate 1:25-cv-01845-NYW-CYC, K Dog Trucking LLC et al v. Fuzion Field Services LLC et al., into the above-captioned case, 1:25-cv-01756-SKC-CYC, Johnson et al. v. Fuzion Field Services LLC et al. The parties in each case agree regarding consolidation. Because these cases involve common questions of law and fact, the Court GRANTS the Motion.
In accordance with the Court's inherent power to control its docket, and with Federal Rule of Civil Procedure 42(a), Civil Action No. 1:25-cv-01845-NYW-CYC is CONSOLIDATED into the above-captioned action, 1:25-cv-01756-SKC-CYC. The cases are consolidated for pretrial matters and discovery. At a later date, the Court will determine if these cases will remain consolidated for trial. Civil Action No. 1:25-cv-01756-SKC-CYC shall be the lead case, and all future filings shall be made in this action only. Pursuant to D.C.COLO.LCivR 40.1(d)(4)(C), the Clerk is directed to reassign Civil Action No. 1:25-cv-01845-NYW-CYC to the undersigned as the Presiding Judge.
