Order on Motion for Leave to File
PAPERLESS ORDER. THIS CAUSE came before the Court upon Plaintiff's Motion to Amend the Complaint. 17 . Therein, Plaintiff seeks leave to file an Amended Complaint to correct an inadvertent scrivener's error in her Complaint. See id. at 1. Plaintiff notes she "attempted to confer with Defendant's counsel regarding the relief sought herein but has not yet received a response." Id. at 2. Local Rule 7.1(a) provides that counsel for the movant must confer with all parties in a good faith effort to resolve the issues in the motion. Accordingly, it is ORDERED AND ADJUDGED that the Motion to Amend the Complaint 17 is DENIED WITHOUT PREJUDICE. The Court notes, however, that the non-moving party's cooperation is equally required by Local Rule 7.1(a). Accordingly, Defendant's counsel is DIRECTED to respond to Plaintiff's counsel's conferral efforts on or before August 20, 2026. Plaintiff shall be allowed to refile the Motion as of August 21, 2026, regardless of whether conferral has occurred. If Defendant has not responded to conferral efforts at that point, Plaintiff shall inform the Court specifically of her conferral efforts. The Court will treat Defendant's failure to respond as an admission that the Motion is unopposed. Signed by Judge K. Michael Moore on 8/18/2026. (srn)
