ORDER granting in part and denied in part 56 Motion to Withdraw as Attorney. Attorneys Leslie K Harrach and Jill J Ormond are relieved of duties as counsel for Defendants/Crossclaim Defendants ENR OH LLC, XSC Phoenix Investment LLC, and XSC Phoenix Club LLC. The Motion is denied to the extent that it requests the Court stay the case for 45 days. The Answer (Doc. 15 ) is stricken as to Defendant XSC Phoenix Club LLC. The Clerk shall enter default against Defendant XSC Phoenix Club LLC. Plaintiffs must file a motion for default judgment against Defendant XSC Phoenix Club LLC as to the claims against it in the First Amended Complaint (Doc. 13 ) no later than two weeks from the entry of default. Crossclaimant Asset Campus USA LLC must file a motion for default judgment against Defendant XSC Phoenix Club LLC as to the claims against it in the Crossclaim (Doc. 74 ) no later than two weeks from the entry of default. This matter is re-referred to Magistrate Judge Deborah M. Fine for purposes of conducting a Settlement Conference. Counsel shall jointly contact the chambers of Magistrate Judge Fine no later than 7 days from the date of this Order to schedule the settlement conference and for instructions regarding preparation for the conference. The Court's Scheduling Order (Doc. 37 ) is amended: Discovery due by 3/22/27. Dispositive motions due by 5/26/27. See Order for further details. Signed by Judge Michael T Liburdi on 9/28/26. (DXD)
