TEXT ORDER: The Court has reviewed Defendant's May 1, 2024 letter [D.E. 50], which seeks leave to file a motion pursuant to Fed. R. Civ. P. 37(b)(2) for Plaintiff's failure to discharge his discovery obligations, most recently by failing to comply with the April 17, 2024 Order [D.E. 49] to produce the materials listed therein. The April 17th Order allowed Plaintiff until April 30th to produce the materials, and Defense counsel represents that Plaintiff's counsel indicated the materials would be produced by April 26th. To date, Defense counsel states, Plaintiff has failed to supply the materials. In view of the delays in discovery production, and to avoid delaying the June 6th settlement conference, Plaintiff must produce the outstanding materials by May 8, 2024. This deadline will not be further extended. So Ordered by Magistrate Judge Michael A. Hammer on 5/2/2024. (Hammer, Michael)

TEXT ORDER: The Court has reviewed Defendant's April 9, 2024 letter [D.E. 48] concerning settlement-targeted discovery. Plaintiff has not objected or otherwise responded to the letter. The Court finds that the documents sought in RFP 36 and 43, the request for legible versions of the text messages labeled BATES PETRA-QASSIS 557-597, the Rule 26 disclosures related to Abbas Hassan, and the response to Interrogatory No. 4 to be reasonable and appropriate under Rule 26. Plaintiff must promptly produce it and, no event, later than April 30, 2024. If that requires an adjournment of the deposition of Paul Qassis so that Defense counsel can review the foregoing materials, the parties shall meet and confer to agree on an alternate date for the deposition. In any event, not later than April 18th, Plaintiff's shall notify Defense counsel of the date that full production will be made, for deposition-scheduling purposes.
