REPORT AND RECOMMENDATIONS re 27 , 56 & 58 -- For the reasons set forth in the attached Report and Recommendations, the Court respectfully recommends that the District Court GRANT Defendants Motions in part and GRANT Plaintiff leave to amend his Complaint. Specifically, the Court respectfully recommends that the District Court find that service was proper on both S. Bacquie and Bacquie Wong and that neither doctrines of res judicata or collateral estoppel bar Plaintiff's claims. The Court respectfully recommends that the District Court (1) GRANT S. Bacquie's Motion to Dismiss for lack of personal jurisdiction; (2) GRANT Defendants' Motions to Dismiss Counts One and Two because Plaintiff has failed to bring timely claims; and (3) GRANT Defendants' Motions to Dismiss Counts Two, Three, and Four for failure to state a claim upon which relief can be granted. Because Plaintiff is proceeding pro se, the Court respectfully recommends that the District Court permit him one opportunity to amend his complaint consistent with this Report and Recommendation.
Objections to R&R due by 8/31/2026. As Defendant S. Bacquie has not yet consented to electronic docket notifications, Plaintiff is directed to serve a copy of this Report and Recommendation on S. Bacquie by August 18, 2026 and file proof of service on the docket immediately thereafter. So Ordered by Magistrate Judge Peggy Cross-Goldenberg on 8/17/2026. (JST)
