ORDER. IT IS THEREFORE ORDERED that New U's motion for summary judgment (ECF No. 373 ) is DENIED.
IT IS FURTHER ORDERED that Counterclaim Defendants' partial motion for summary judgment (ECF No. 372 ) is granted as to (1) the fraud counterclaim against King, Fairchild, T1UK, and the Pixxles Counterclaim Defendants, (2) the conversion counterclaim against King, Fairchild, and the Pixxles Counterclaim Defendants, (3) the civil theft counterclaim against Counterclaim Defendants, (4) the unjust enrichment counterclaim against King, Fairchild, T1UK, and the Pixxles Counterclaim Defendants, (5) all Nevada RICO claims against King, Fairchild, T1UK, and the Pixxles Counterclaim Defendants, and the Nevada RICO claim against Kasdon for extortion; and (6) the assertion of alter ego liability as to Pixxles Counterclaim Defendants.
IT IS FURTHER ORDERED that New U's motions to seal (ECF Nos. 374 , 388 ) are GRANTED.
