Minute Entry for proceedings held before Judge Lynn Adelman: Status Conference held on 10/6/2026. Parties discussed defendants' motion for interlocutory appeal; plaintiff's motion to reconsider the Relevant Time Period for court's previous order compelling discovery; and issues related to a potential stay. Defendants were permitted to make oral arguments in lieu of filing a reply brief on the interlocutory appeal issue. Finding that no further briefing was necessary on this discretionary issue, the court DENIED defendants' motion to certify an interlocutory appeal (ECF No. 117 ). The court found that no exceptional circumstances exist to justify a departure from the normal policy of postponing appellate review until after a final judgment, and an interlocutory appeal would not speed up this litigation. After due consideration, the court STAYED consideration of plaintiff's motion to reconsider until such time as the Seventh Circuit issues a decision in Martinsville II. In the meantime, the court will permit the parties to brief the issue of the application of FERPA to bar certain discovery sought by plaintiff. Defendants may file a memorandum on this issue only by October 20, 2026. Plaintiff may file a response on this issue by November 10, 2026. Parties should limit their briefs to 10 pages each.
