MINUTE entry before the Honorable Jeannice W. Appenteng: In-person hearing held on 5/7/2024. The parties were permitted to continue their conferral efforts regarding plaintiff's motion to compel 81 , and represented they made further progress towards resolving the issues raised in plaintiff's motion. Regarding plaintiff's request for contracts between defendant and those insurance carriers for whom defendant conducts telemarketing services (defendant's "uplines") (see RFP 15), for now, the Court will not order the production of those contracts and accordingly denies plaintiff's request without prejudice. Rather, the parties shall first conduct ESI discovery, for discoverable information related to plaintiff's claim and class allegations which ultimately may include the production of executed contractsthat is in defendant's possession, custody, or control. As stated during the hearing, the Court will contact the parties to find a mutually agreeable date and time for a telephonic status hearing to discuss (1) the progress the parties made regarding the outstanding disputes given the Court's ruling regarding plaintiff's RFP 15 and (2) discovery benchmarks and deadlines. In the meantime, the parties shall continue negotiating an ESI protocol and potential custodians and search terms. On 5/8/2024 the Court will issue an order setting the telephonic status hearing and a date for the parties to report on the progress negotiating an ESI protocol, potential custodians, and search terms. Lastly, the parties shall continue their discussions regarding defendant's motion to quash 106 .
