Status Conference Order on Oral Motion
TEXT MINUTE ENTRY for telephonic status conference held before Magistrate Judge Ryan C. Carson on September 9, 2026. Alexis Mullaney appeared for Plaintiff. Audrey Svane and Mariah McGrogan appeared for Defendant. The parties discussed case progression, interest in mediation, and trial setting. The parties advised that written discovery has closed, however the parties have an outstanding discovery dispute that they are attempting to resolve without court intervention. If the parties are unable to resolve their dispute, they shall contact chambers and the court's standard discovery dispute procedures will apply. In the light of the outstanding dispute, Defendant orally moved for a thirty (30) day extension to the dispositive motion deadline. Without objection, that motion is granted. The parties shall have until November 4, 2026 to file any dispositive motions. All other progression deadlines remain unchanged. The parties have attended mediation once and are open to doing so again. The court encourages the parties to contact Mr. Mullin to schedule a second mediation in advance of the new dispositive motion deadline. The parties shall notify chambers if a second mediation is scheduled. This matter is set for a further status and trial setting call on November 6, 2026 at 10:30 AM before Magistrate Judge Ryan C. Carson. The parties shall use the case conference instructions at Filing No. 11 to participate in the call. The court noted that Ms. Terry White and Mr. Matthew McKeever remain counsel of record on the docket. Plaintiff agreed to reach out to Mr. McKeever today regarding their withdrawal so that the docket accurately reflects Plaintiff's current representation.
