MEMORANDUM (Order to follow as separate docket entry) re 13 MOTION TO DISMISS FOR FAILURE TO STATE A CLAIM MOTION to Dismiss for Lack of Jurisdiction filed by Marcia Fudge. The respondents motion to dismiss (Doc. 13) will be denied. The decision of the ALJ granting summary judgment in favor of the agency and against HARIE on Count 2 of the administrative complaint will be vacated. The matter will be remanded to the ALJ for further proceedings consistent with this memorandum opinion and order with respect to Count 1 of the administrative complaint. This federal civil action for judicial review will be stayed pending a final determination by the agency with respect to Count 1.An appropriate order follows.
