Gee: Having considered Plaintiffs' Motion for Final Approval of Class Action Settlement [filed under CV 19-00976 DMG (JCx), Doc No. 116], Motion for Attorneys' Fees and Costs and Class Representative Service Award [filed under CV 19-00976 DMG (JCx), Doc No. 115], and Motion to Amend Final Order and Judgment and Approve Distribution of Post-Judgment Interest, Attorneys' Fees, and Costs [filed under CV 19-00976 DMG (JCx), Doc No. 151], IT IS HEREBY ORDERED, ADJUDGED AND DECREED that the Court authorizes the Settlement Administrator to pay the Individual Settlement Awards to the Class Members in accordance with the terms of the Stipulation, plus post-judgment interest in accordance with the terms of the Forbearance Agreement. Defendants have paid $10,308,216.26, which includes the Maximum Settlement Amount of $9,500,000.00, post-judgment interest in the amount of $699,396.60, post-judgment attorneys' fees in the amount of $88,237.00, and post-judgment costs in the amount of $20,582.66. Plaintiffs Juana Olivos Valdez, Danillie Willie, and Christine Espinosa shall each be paid a Class Representative Service Award in the amount of $15,000 from the Maximum Settlement Amount, plus $1,104.31 in post-judgment interest. Class Counsel shall be paid $2,375,000 as their attorneys' fees from the Maximum Settlement Amount, plus $174,849.15 in post-judgment interest, for a total of $2,549,849.15. Class Counsel shall also be paid $112,688.37 for reimbursement of costs and expenses from the Maximum Settlement Amount, plus $8,296.20 in post-judgment interest, for a total of $120,984.57. Aequitas Legal Group shall be reimbursed $22,076.96 for its costs and post-judgment interest on its costs, and Matern Law Group shall be reimbursed $98,907.61 for its costs and post-judgment interest on its costs. The California Labor and Workforce Development Agency shall be paid $213,750.00 as penalties, plus $15,736.42 in post-judgment interest, for a total of $229,486.42. CPT Group, Inc. shall be paid Settlement Administration Costs in the amount of $58,000.00, plus post-judgment interest in the amount of $4,270.00, for a total of $62,270.00. The Net Settlement Amount to be distributed to all the class members shall be in the amount of $6,695,561.63 from the Maximum Settlement Amount, plus $492,931.90 in post-judgment interest, for a total of $7,188,493.53. Gee: Having considered all papers filed in connection with the Final Approval Hearing, including plaintiffs Juana Olivos Valdez, Danillie Willie, and Christine Espinosa's Motion for Final Approval of Class Action Settlement [filed under CV 19-00976 DMG (JCx), Doc No. 116] and Motion for Attorneys' Fees and Costs and Class Representative Service Award [filed under CV 19-00976 DMG (JCx), Doc No. 115], oral argument made at the Final Approval Hearing, and for the reasons stated on the record at the Final Approval Hearing on 10/21/2022, and in accordance with Plaintiff's unopposed Ex Parte Application for Order for Entry of Plaintiff's Proposed First Amended Judgment [filed under CV 19-00976 DMG (JCx), Doc No. 125], IT IS HEREBY ORDERED, ADJUDGED AND DECREED that Defendants shall be required to pay the Maximum Settlement Amount of $9,500,000.00. Plaintiffs Juana Olivos Valdez, Danillie Willie, and Christine Espinosa shall each be paid a Class Representative Service Award in the amount of $15,000 from the Maximum Settlement Amount in accordance with the terms of the Stipulation. Class Counsel shall be paid $2,375,000 as their attorneys' fees and $112,688.37 for reimbursement of costs and expenses from the Maximum Settlement Amount in accordance with the terms of the Stipulation. Aequitas Legal Group shall be reimbursed $20,563.09 for its costs, and Matern Law Group shall be reimbursed $92,125.28 for its costs. The California Labor and Workforce Development Agency shall be paid $213,750.00 as penalties under the Private Attorneys' General Act. CPT Group, Inc. shall be paid Settlement Administration Costs in the amount of $58,000.00. The Net Settlement Amount to be distributed to all the class members shall be in the amount of $6,695,561.63. The Court further hereby enters judgment for Plaintiffs and the Class Members for post-judgment interest against Defendants, commencing on the date the original judgment was entered on 10/21/2022, together with interest as provided by law.
