Electronic Minute Order for the Initial Conference held on August 6, 2026, before Magistrate Judge James M. Wicks.

THE FOLLOWING RULINGS WERE MADE:
Following discussion with counsel during the Initial Conference and review of the submitted worksheet, the Court adopted a Scheduling Order which is attached at ECF No. 24 .
A Status Conference has been scheduled for December 22, 2026, at 10:30 AM via the Court's Video Zoom. A Final Pre-Trial Conference has been scheduled for July 1, 2027, at 9:30 AM via the Court's Video Zoom. The Court will e-mail the Zoom invitations closer to the conference dates. All participants involved shall comply with Judge Wicks' Individual Rules regarding Expectations for Remote Appearances (see Rule § 1E). A proposed Joint Pre-Trial Order ("JPTO") in compliance with the Individual Practice Rules of the Hon. Gary R. Brown, signed by counsel for each party, must be filed on ECF by June 24, 2027. If a Motion for Summary Judgment is pending, the Pre-Trial Conference will be cancelled and filing of the proposed JPTO will be held in abeyance.
Plaintiff advised the Court that he does not object to the Defendants' Motion to Seal (see ECF No. 19 ). The Court's decision on the motion is RESERVED, and the Court will issue a written decision.
The Court is in receipt of Defendants' Motion to Dismiss (see ECF No. 18 ) and the parties are reminded that the Plaintiff's Opposition shall be filed and served by August 28, 2026, and Defendants' Reply shall be filed and served by September 11, 2026. A Motion Hearing/Oral Argument is set for September 23, 2026, at 12:00 PM before the undersigned in Courtroom 1020, of the Alfonse M. D'Amato U.S. Courthouse, 100 Federal Plaza, Central Islip, N.Y. 11722.
The Court respectively recommends that the Pro-Se Plaintiff seek the assistance of the Hofstra University Pro-Se Legal Assistance Program for guidance in litigating this case. The Clerk of Court need not serve a copy of this Electronic Minute Order as the Pro-Se Plaintiff was granted leave to electronically file and receive ECF notifications (see Order dated July 8, 2026).
