   STIPULATION AND ORDER OF SETTLEMENT: NOW, THEREFORE, in consideration of the mutual promises set forth herein, it is agreed by and among the Parties as follows: The Defendants acknowledge they have failed to: (a) timely remit fringebenefits and deductions due to Plaintiffs for various through November 2021; and (b) remit all fringe benefits and deductions due to Plaintiffs for various months between May 2021 and December 2021 in the repo1ted total amount of $152,931.62; The Defendants have agreed to remit, and Plaintiffs have agreed to accept, $131,292.47 (the "Settlement Amount") in settlement of the amounts due as listed in, Paragraph 1 of this Stipulation, plus damages as provided for under ERISA, the CBA, Trusts Agreements and Collections Policy; And as set forth herein.
