Order on Letter Request
TEXT ORDER: The Court held a discovery conference to address the issues raised in Dkt. Nos. 160, 161, and 163, together with the parties related submissions. Upon consideration of the parties letters and the arguments presented during the conference, it is hereby ORDERED as follows: With respect to the issues raised in Dkt. No. 161 concerning Plaintiffs supplemental disclosures under Fed. R. Civ. P. 26(a)(1)(A)(i), Plaintiff shall serve a further supplemental disclosure identifying, for each newly disclosed witness who remains listed, the subject matter of that witnesss discoverable information with reasonable specificity of the unique subject matter and factual basis of each witnesss purported knowledge. Plaintiff shall also provide all contact information presently known to Plaintiff after reasonable inquiry. Plaintiff shall further remove from the disclosure any witness upon whom Plaintiff does not reasonably intend to rely in establishing her claims. If, following the ordered supplementation, a newly disclosed witness remains listed but is described only in generic, boilerplate, or otherwise undifferentiated terms, the Court reserves to Defendants the right to challenge Plaintiffs use of that witness pursuant to Fed. R. Civ. P. 37(c)(1). The matters raised in Dkt. No. 160 were addressed during the discovery conference and require no further action by the Court. The parties are advised that going forward, any supplementation pursuant to Fed. R. Civ. P. 26 shall be made through a clearly designated written supplemental disclosure that specifically identifies the information being added, amended, or otherwise supplemented. With respect to Dkt. No. 163, Defendant United States Olympic & Paralympic Committee (USOPC) represented to the Court that it has complied with its obligations under Fed. R. Civ. P. 26; the parties discovery demands; and the parties stipulated ESI protocol. USOPC is directed to confirm that no additional responsive data or information remains in its possession, custody, or control that has not been produced. In all other respects, as discussed and for the reasons stated on the record during the discovery conference, the relief requested in Dkt. No. 163 is DENIED. All other requests for relief relating to these discovery disputes are denied except as expressly set forth herein or during the discovery conference. IT IS SO ORDERED.
