MINUTE entry before the Honorable Sunil R. Harjani: The Court has reviewed the joint status report. The Court prefers consolidated briefing so that it can review and decide the remand matter through a single set of consolidated briefs. This is purely for judicial efficiency and to make it easier for the Court to review the issues. Plaintiffs and Defendants will each receive 30 pages and the reply brief shall be 15 pages. That is enough in the Court's view to consider and decide this issue. The following schedule will govern: (1) opening brief due 10/30/26; (2) response brief due by 11/13/26 and (3) reply brief due by 11/24/26. Because the parties have already written large portions of the briefs, the Court finds this schedule fair to all parties. On consolidation, that seems unnecessary now until the motion to remand is decided and the Court knows whether these five cases will continue before it. With respect to the comment that Plaintiffs intend to object to Professor Porter, formal motion practice seems unnecessary now. The Court has no idea why there is an objection, but it seems it can be dealt with at the Daubert hearing and then the parties can file any motion they wish on the independent experts. To the extent it involves his adult son's future employment at Econic, the Court discloses that it requested his son be screened off from all matters involving Delta Dental, and Professor Porter has confirmed that.
