EO: In light of the 162 Amended Order Certifying Questions of Law to the Hawai'i Supreme Court, the court orders a stay of all proceedings pending a decision by the Hawai'i Supreme Court. The Clerk of Court is directed to administratively close this action without prejudice to any party. All dates and deadlines are vacated. During the closure period, the court may convene conferences or take other action deemed appropriate by the court.
The closing is administrative only and thus has no effect on the procedural or substantive rights of any party. Within sixty days after the Hawai'i Supreme Court rules, any party may move to reopen the case. This administrative closure has no impact on any limitation period applicable to this case, does not alter in any manner any previous rulings by the court, and does not require a filing fee to reopen the case. IT IS SO ORDERED.
