TEXT ORDER-- The Court is in receipt of Plaintiff's motion seeking leave to file a third amended complaint in order to reinstate claims that were previously dismissed by District Judge Arleo. (ECF No. 82 ). The motion is DENIED. First, Plaintiff's statement that "this motion is submitted pursuant to the express permission granted by the Court during the status conference held on August 17, 2026" is inaccurate. The undersigned reviewed the audio recording of the conference conducted on August 17, 2026, wherein the undersigned specifically: (1) did NOT grant Plaintiff leave to file this particular motion; (2) advised Plaintiff that the undersigned lacks the authority to reinstate the claims at issue; and (3) advised Plaintiff that the undersigned "will leave you to address what you'd like to address before Judge Arleo... but it's not going to be via a motion to amend." Second, Plaintiff has already been advised by text order on June 25, 2026 that such relief is barred. (See ECF No. 60 ). So Ordered by Magistrate Judge Stacey D. Adams on 9/11/2026. (JB)

Order on Motion to Adjourn Conference
ORDER. The 39 Motion to Adjourn Conference is granted. The settlement conference is adjourned to December 2, 2026 at 2:30 p.m. by video before Magistrate Judge Peggy Kuo. A link to access this Zoom meeting will be provided to counsel separately.
Representative of Plaintiff, Defendants, and Third-Party Defendants with complete settlement authority (other than counsel) must be present.
The parties are directed to submit confidential ex parte settlement statements to Kuo_Chambers@nyed.uscourts.gov by November 23, 2026. The statements must include the last offer and demand, and a frank assessment of the strengths and weaknesses of each party's case. For guidance on the requirements for the statements, the parties should consult Magistrate Judge Peggy Kuo's Individual Practice Rules. The Court will schedule ex parte telephone calls with counsel after review of the statements.
