MINUTE ORDER issued by Courtroom Deputy for District Judge Daniel J. Calabretta on 9/2/2026: On July 8, 2026, Plaintiff filed a Motion to Strike the claims of Phuc X. San and Zhen Nan Chen. (ECF No. 118 .) An opposition, or statement of non-opposition, to the granting of this motion was required to be filed and served no later than fourteen (14) days after said motion was filed. See E.D. Cal. L.R. 230(c). Neither party responded within this timeframe. On August 20, 2026, the Court ordered these parties to respond to Plaintiff's motion (ECF No. 118 ) within seven days and warned that failure to do so may be construed by the Court as non-opposition and could result in the granting of Plaintiff's motion. (ECF No. 126 .) To date, neither party has responded. Accordingly, Plaintiff's Motion (ECF No. 118 ) is taken under submission pursuant to Local Rule 230(g) and GRANTED. The claims of Phuc X.
