Status Conference
Minutes of proceedings [non-document] before Judge J. Philip Calabrese. On July 30, 2026, the Court held a status conference by Zoom. Brent Silverman appeared on behalf of Plaintiff. Joseph Simms and Harry P. Giegerich appeared on behalf of Defendants. The parties reported that written fact discovery is extensive and ongoing. During discovery, they reached impasse on one issue, namely, whether Plaintiff may discover information relating to piercing the corporate veil. After hearing counsels respective views on this issue, the Court determined that such discovery is largely premature. However, Defendants should produce organizational charts and operating agreements now as general corporate background. The Court directed the parties to continue working toward their proposed fact discovery deadline of December 31, 2026. In the meantime, the Court will take up the request for letters rogatory. The next status conference will take place on October 16, 2026 at 3:00 p.m. via Zoom. Time: 30 minutes. (Y,A)
