Defendants report that they have thoroughly considered Plaintiff's updated demand letter, researched the relevant issues, and analyzed the prospects of settlement at multiple levels of review. Based on that review, Defendants state that they are not interested in further settlement discussions at this time and believe they have a good faith argument for a fully dispositive summary judgment motion that they wish to pursue. Accordingly, the in-person status hearing set for 9/29/26 is stricken. The parties shall file a joint status report on 11/17/26 confirming that Dr. Argumedo's deposition has been taken and that all expert discovery is complete.
