Order on Motion for Miscellaneous Relief
ORDER denying without prejudice 20 motion for modification and waiver of security. Defendants may request a cash deposit or bond to the amount of $500 "as security for costs." L.R. 83.3(a). The amount may be changed "at any time" for "good cause found by the Court." Id. And, "[u]pon good cause... the Court may modify or waive the requirements of this Rule." L.R. 83.3(b). The primary purpose of the bond requirement is to ensure "that whatever assets a party does possess will not have been dissipated or otherwise have become unreachable by the time such costs actually are awarded." Santora v. All About You Home Care Collaborative Health Care Serv, LLC, No. 9-CV-339 (DJS), 2010 WL 4942665, at *3 (D. Conn. Nov. 23, 2010). Good cause can be shown by an inability to post the required amount. Leighton v. Paramount Pictures Corp., 340 F.2d 859, 861 (2d Cir. 1965). Defendant asserts that Plaintiff failed to establish good cause, as his motion for waiver of the bond obligation does not contain the financial details necessary to determine whether he would be unable to pay the required amount. ECF No. 24 . Good cause for a waiver is not shown when "assertions of financial inability are conclusory and unaccompanied by details or supporting documents." Id.; see also Sanchez v. City of Hartford, No. 3:25-cv-01444 (OAW), ECF No. 21 (D. Conn. Oct 28, 2025) (denying the plaintiff's request for waiver of the bond obligation because the "[p]laintiff does not provide any type of financial affidavit through which the court can find an inability to pay or assess good cause to grant the Motion"); Huminski v. Connecticut, No. 3:14-cv-1390 MPS, 2015 WL 1825966, at *2 n.5 (D. Conn. Apr. 22, 2015) (same). As Defendant points out, Plaintiff did not provide financial documents or other supporting information. ECF No. 24 . Accordingly, Plaintiff's 20 motion for modification and waiver of security is denied without prejudice. Should Plaintiff "wish to show his inability to satisfy the bond requirement, he may file a new, properly supported motion to vacate or modify pursuant to D. Conn. L. Civ. R. 83.3(b)." Santora, 2010 WL 5942665, at *3 (citation modified). He may support his motion with financial statements, a breakdown of monthly expenses, or other documentation. Sanchez, 3:25-cv-01444 (OAW), Doc.
