NOTICE OF MOTION. PLEASE TAKE NOTICE that, upon the annexed Declaration of Gene Lim dated September 2, 2026, and the exhibits annexed thereto, and the accompanying Memorandum of Law, Defendant Gene Lim, appearing pro se and in his individual capacity, will move this Court, before the Honorable Mary Kay Vyskocil, United States District Judge, at the Daniel Patrick Moynihan United States Courthouse, 500 Pearl Street, New York, New York 10007, on a date and at a time designated by the Court, for an Order: 1. Vacating the Judgment entered against Defendant Gene Lim on October 11, 2024 [ECF No. 124], pursuant to Federal Rules of Civil Procedure 60(d)(3) and 60(b)(6); 2. Vacating the Opinion and Order entered March 26, 2024 [ECF No. 112], upon which that Judgment rests, to the extent it granted partial summary judgment against Mr. Lim and denied his motion to dismiss under Rule 12(b)(7); 3. Reopening this action for further proceedings; 4. Staying enforcement of the Judgment pending determination of this motion pursuant to Federal Rule of Civil Procedure 62(b); and 5. Granting such other and further relief as the Court deems just and proper. PLEASE TAKE FURTHER NOTICE that pursuant to Local Civil Rule 6.1(b), opposing papers shall be served within fourteen days after service of these moving papers. Document filed by Gene Lim.
