ORDER: On August 16, 2021, the Court issued an order granting in part and denying in part without prejudice the plaintiffs motion for default judgment (ECF No. 35). The order stated that if the plaintiffs wished to submit a renewed motion for default judgment, they had to do so, and file supporting papers specified in the order, within thirty days of the Courts August 16 ruling. More than thirty days have passed and nothing has been filed. Accordingly, as the Court indicated it would in the August 16 order if nothing was filed, it now DISMISSES Counts 1 and 3-9 and the portions of Count 2 seeking relief other than injunctive relief, and enters the following permanent injunction as to Count 2: Defendants and their officers, agents, servants, employees, and attorneys, and any persons who are in active concert or participation with them, are hereby permanently enjoined from using Plaintiffs' images on their social media pages or in any advertisements or publicity concerning their establishment (or any related establishment), unless they obtain consent to do so in a writing signed by Plaintiffs or their attorneys. The plaintiffs shall serve a copy of this order on the Defendants. The Clerk is instructed to close this case.
