ORDER granting 133 Letter Motion for Conference: A conference on Defendants' motion for early determination of a legal issue was held on July 6, 2026. For the reasons explained on the record at that conference, the Court finds that 15 U.S.C. § 377(b)(1)(A)(ii) provides for a maximum civil penalty calculation of 2% of nationwide gross sales, on a per violation basis. This ruling is without prejudice to any argument that any party may make, at the appropriate time, regarding the actual penalty, if any, to be imposed in this case. Further, the parties are ORDERED to confer and, by July 13, 2026, submit a letter 1) indicating whether they have contacted or plan to contact Judge Figueredo to reschedule the settlement conference; 2) proposing a realistic schedule for concluding outstanding fact discovery. The parties are reminded that this schedule will not be further extended absent extraordinary circumstances that could not have been anticipated as of July 13. Defendants are further ORDERED, by July 20, 2026, to file a letter updating the Court on the status of the State Plaintiff's and the state agencies' productions; the State may file a response by July 24, 2026, if they choose.
